Terms of Service
1. Purpose
These Terms of Service govern access to and use of the UptimePoint platform.
2. Services
UptimePoint is a website monitoring platform that provides uptime monitoring, SSL certificates, domains, DNS, performance, security, ports, ping, keywords and UDP checking services. Available features depend on the subscribed plan.
3. Registration and account
Users register by providing accurate and complete information. They are responsible for maintaining the confidentiality of their credentials. Any access via their account is deemed to have been made by them.
4. Plans and billing
Offered plans are Free, Solo, Team, Enterprise and Enterprise+. Prices are indicated in euros or dollars depending on the plan. Payment is processed via PayPal or USDT (TRC20). Subscriptions auto-renew unless cancelled before the renewal date. Refunds are available within 14 days for new subscribers.
5. Acceptable use
Users shall not use the platform to monitor sites without authorization, circumvent plan limits, compromise system integrity, or send abusive requests.
6. Limitation of liability
UptimePoint strives to provide a reliable service but cannot guarantee absolute availability. UptimePoint's liability is limited to the amount paid by the user in the last 12 months. UptimePoint is not liable for indirect damages resulting from use of the service.
7. Personal data
Personal data is processed in accordance with our Privacy Policy. Users have the right to access, rectify and delete their data.
8. Term and termination
The contract is for the duration of the subscribed plan. Users may cancel at any time from their dashboard. UptimePoint may terminate the contract in case of violation of these Terms, with pro-rata refund.
9. Definitions
« Platform » means the UptimePoint service accessible at uptimepoint.com. « User » means any individual or legal entity using the Platform. « Account » means the secure space allowing the User to access the Services. « Subscription » means the paid plan subscribed to by the User.
10. Intellectual Property
All elements composing the Platform (software, code, design, trademarks, logos, content) are the exclusive property of UptimePoint or its licensors. Any unauthorized reproduction, representation, modification or exploitation is prohibited. The User receives a non-exclusive, non-transferable license limited to the duration of their Subscription to use the Platform in accordance with these Terms.
11. Force Majeure
UptimePoint shall not be held liable for any failure or delay in performing its obligations due to a force majeure event as defined by applicable case law, including but not limited to: natural disasters, pandemics, acts of terrorism, strikes, power or telecommunications outages, failures of third-party infrastructure (cloud providers, DNS registries, certification authorities).
12. Changes to Terms
UptimePoint reserves the right to modify these Terms at any time. Users will be notified by email of any material changes at least 30 days before they take effect. Continued use of the Platform after the changes take effect constitutes acceptance of the new Terms. In case of refusal, the User may terminate their Subscription under the conditions set out in Article 8.
